Indigent Defense - Assigned Counsel & Experts

Indigent criminal defense assigned counsel & other experts program.

When a Placer County’s contracted primary Public Defender and first and second level conflict firms must declare a legal conflict of interest, the Assigned Counsel Program establishes a process which enables the Superior Court to access and appoint an attorney from a list of interested pre-qualified attorneys to provide defense services. Attorneys who wish to participate in the Assigned Counsel Program are asked to submit a resume of experience with their area of specialty including their State Bar Number. Resumes and any pertinent documentation should be sent to the: Superior Court P.O. Box 619072 Roseville, CA 95661-9072

Applications are then reviewed by the Presiding Judge and other members of the Bench. Those accepted as an Assigned Counsel Program attorney will be notified by telephone. Attorneys will be appointed at one of four class levels pursuant to the Superior Court of California, Placer County Local Rules (Rule 60.1). Federal & State Forms

Once appointed, the attorney must complete an Internal Revenue Service ( IRS ) form W-9 and a  State CA-590 form to the: Placer County Auditor-Controller 2970 Richardson Drive Auburn, CA 95603

Submitting the form W-9 and CA-590 is required only once to establish the attorney as a vendor doing business with Placer County.

Payment Voucher

To receive payment for services on a case-by-case basis through the Placer County Assigned Counsel Program, the attorney must complete a Payment Voucher (PDF) . Complete instructions and procedures regarding payment are included in the document. The Court reviews and approves all attorney claims prior to submitting to Placer County, the responsible agency for payment of qualified Indigent Defense expenditures.

What is “mac”.

MAC is short for Managed Assigned Counsel. The MAC system is a new, simplified way of contracting. It will be an hourly based system, with monthly payments made using the current private assigned counsel rates for time worked the previous month.

Indigent Defense

The Office of Indigent Defense DOES NOT PROVIDE LEGAL ADVICE AND IS NOT A LAW FIRM.

The Office of Indigent Defense consists of the Public Defender’s Office, the Conflict Defender’s Office, and the Assigned Counsel Program.

The St. Lawrence County Public and Conflict Defender Offices represent individuals in local criminal courts, County Court, Supreme Court, and Family Court.  Neither office is a private law firm and may only represent individuals assigned by the Office of Indigent Defense who have cases pending in St. Lawrence County.  Cases that cannot be assigned to the Public Defender's Office are assigned to the Conflict Defender's Office; this is done when there is a conflict of interest.  If neither office can provide services due to a conflict of interest, the case is then forwarded to the Assigned Counsel Program for assignment.

The Public and Conflict Defender's Offices  do not  handle civil cases, including divorces, landlord/tenant matters, medical malpractice/personal injury claims, or credits and judgments.

The eligiblity screening process provided by the Office of Indigent Defense serves as an aid to the Court; the power to determine whether an individual defendant is eligible for assigned counsel rests with the Court.  The Office of Indigent Defense Coordinator is responsible for accepting, reviewing, and assigning cases to the Public or Conflict Defender's Offices, or when applicable, forwarding cases to the Assigned Counsel Coordinator for assignment to the 18B Panel or private local attorneys.  Case eligibility is determined by the charge and the financial status of the applicant.   It is important that you submit all court documents and verification of assistance or income with your application.    

Individuals who believe they may qualify for free attorney services may apply for legal representation through the Office of Indigent Defense, located on the first floor of the stone building on the corner of Court Street and Judson Street.  Office hours are Monday through Friday from 8:00 a.m. until 4:00 p.m.  Clients may contact the office at (315) 379-2401 during business hours.
