With the exception of some few countries in Africa such as South Africa and Cape Verde, lesbians, gays, bisexuals and trans genders (LGBTQ) right in Africa are limited. Unlike Europe, America, Asia and other continents where these practices are largely acceptable. In most cases, the argument in Africa here is that, these practices are "un-African". "Un-African" in the sense which I think is as a result of the fact that these acts are not acceptable and have never been accepted in the various cultures found in Africa. Over the years, people have been using the word "Un-African" to signify a lot of things without considering the logical implications of the word. However, this article seeks to argue that, logically speaking there is no clear definition of what is African and Un-African hence a statement like "Homosexuality is un-African" is an empty statement and statement like that does not say anything meaningful. The paper will also examine the logical Implication of the definition of "un-African " and lastly the paper will be narrowed down to the Ghanaian society to analyse the anti-LGBTQ bill in the light of Nkrumah's Philosophy (Consciencism).

The paper sought to demonstrate that if homosexuality is determined then an ethics of tolerance should be adopted in order to cater for people who have no choice in their being who they are. It was observed that moral theories rest their conclusions on the assumption that the human being is responsible for all their actions and hence should be held morally accountable for them. However, in light of deterministic factors both in the individual and their environment, this responsibility in terms of choosing to become homosexual is taken away. Hence, the harsh treatment that these people receive on the African continent can be seen from this perspective as unwarranted, and it is high time that these factors need to be taken into consideration for the betterment of Africa’s future. The previous paper argued that certain types of food could cause hormonal imbalances. The natural response to this argument is that people should refrain from eating them. There is more to this than meets the eye. The social status of different members of society is such that they cannot afford variety and to avoid such food as soya beans and soya chunks. This is the normal food consumed by average people especially in Zimbabwe. There is also the regional or geographical argument that suggests that some countries have staple foods most of the listed food. This is what can be properly grown in their climatic regions and geographic soil. In view of such issues, it is apparent to posit that one cannot starve for fear of inciting hormonal imbalances. One can now fully appreciate the dilemma that is at hand.

The laws against the homosexual people 'were wrong then, and they are wrong now. As the UK's prime minister, I deeply regret both the fact that such laws were introduced, and the legacy of discrimination, violence and even death that persists today'.-Theresa May, Former UK Prime Minister Are we really sorry and acting accordingly? Is the law, legal discourse, judges, and the legal arena as a whole really sorry for what the law did and, has been doing, against the homosexual people? Masterpiece, Lee, Lawrence, Navtej and other cases tell us a different story. The glorious judgements have fundamental flaws in consequence of which right of the homosexual people has been interpreted as kindness and sympathy of the heterosexual majority. The glorious judgements have failed to understand the dynamics of the relationship and, hence, failed to show due regard to the homosexual people. Consequently, millions of homosexual people are, still, being discriminated, humiliated and stigmatised around the world. Still, they are suffering in every sphere of their lives and their continuous struggle for their rights is likely to be continued in the years to come. The article wants to point out that the reason behind the failure of the glorious judgements is that the judgments underestimate or overlook the primary and independent justification ie the inevitable need of the body. Instead, the judgements are founded on the personal choice-based secondary justifications which are self-contradictory, self-limiting, self-defeating, confusing and dependent. Consequently, the fate of the homosexual people is swaying on the fulcrum of principles, provisos, and probabilities. The article makes an attempt to challenge the lines of arguments the judgments are based on showing the flaws and the problems, if not dangers, of following these lines of arguments. To deal with this issue effectively, practically, and meaningfully, the article wants to present the primary justification based on the inevitable needs of the human body and the suitable approach focusing the needs of the body. Finally, the article tries to assess the prospects of the primary justification and the approach.
