An assignation is a secret meeting. You might have an assignation with your new girlfriend if the two of you were keeping your relationship private.

Any kind of clandestine meeting can be called an assignation , but it most often describes a romantic tryst. Every encounter between the two main characters in Shakespeare's "Romeo and Juliet" is an assignation, since their families don't approve of their relationship. The word assignation meant "appointment by authority" in the 14th century, from the Latin assignationem , "an assigning or allotment," with the "meeting by arrangement" meaning arising in the late 17th century.

Supreme Court rules on Idaho abortion, EPA, Purdue bankruptcy and SEC cases, leaves Trump immunity for another day

The Supreme Court on Thursday issued four significant rulings, including overturning a Purdue Pharma bankruptcy plan that would have provided billions of dollars to help address the nation’s opioid crisis in exchange for protecting the family that owns the company from future lawsuits. It also ruled against in-house Securities and Exchange Commission tribunals, blocked an Environmental Protection Agency air-quality initiative while appeals continue and formally issued a decision allowing emergency abortions in Idaho while that case makes its way through the courts. Other decisions, including whether Donald Trump is immune from prosecution in his federal election-interference case, remain to be issued, and the court — which usually winds up its term in June — will continue to issue decisions into July.

Matt Vierling hacked at an Aaron Nola sinker in the third inning of Monday’s game between the Phillies and Tigers . He cracked his bat in half. The ball floated into Nola’s glove. Two Tigers on base had no idea. Nola fired to first base for the second out. Bryce Harper took his time, lobbed the ball to Alec Bohm at third base, and it was done.

It was the first triple play in Major League Baseball this season and the first 1-3-5 triple play since July 11, 1929, according to SABR’s database .

The Phillies had not turned a triple play since 2017 when Rhys Hoskins was a rookie left fielder and he initiated a 7-4-3 triple play . This was the first triple play involving a Phillies pitcher since Aug. 15, 1964, and the shortstop in the middle of that play was Ruben Amaro. His son, Ruben Amaro Jr., was in the ballpark Monday night broadcasting the game for NBC Sports Philadelphia.

Qu’est-ce qu’une assignation en divorce .

Quand les époux ne parviennent pas à se mettre d’accord et qu’un divorce à l’amiable n’est pas possible, ils se tournent vers l’assignation en divorce.  Cette procédure implique de déposer une demande écrite auprès du Tribunal judiciaire pour demander le divorce.  Avant le 1er janvier 2021, l’assignation intervenait après l’établissement de l’ordonnance de non-conciliation. Le demandeur disposait alors d’un délai de trois mois à partir de la délivrance de cette ordonnance pour assigner son conjoint en divorce.

Depuis le 1er janvier 2021, l’assignation introduit directement l’instance en divorce. Ainsi, le Tribunal judiciaire est saisi par l’avocat dès que l’acte de procédure est délivré. Dans cette optique de simplification des procédures, les époux doivent constituer avocat dès que l’assignation est lancée.

Qu’est-ce qu’un jugement de divorce ? 

Le jugement de divorce est une décision rendue par un juge des affaires familiales. Il prononce officiellement la dissolution du mariage  et règle les conséquences du divorce, telles que la garde des enfants, la pension alimentaire, la répartition des biens, etc. Le jugement intervient à l’issue de la procédure judiciaire de divorce, que ce soit par consentement mutuel (avec juge) ou pour un divorce contentieux. Il contient les motivations et les décisions du tribunal concernant les aspects du divorce.

Quelle est la différence entre l’assignation de divorce et le jugement de divorce ? 

L’assignation de divorce est le document juridique par lequel l’un des époux, appelé le demandeur, informe officiellement l’autre époux, appelé le défendeur, de son intention de divorcer . Elle marque le début formel de la procédure de divorce. Ce document est rédigé par l’avocat du demandeur et signifié par un huissier de justice au défendeur. L’assignation précise les motifs du divorce, les demandes relatives à la garde des enfants, à la pension alimentaire, à la prestation compensatoire, et à la répartition des biens. Une fois l’assignation signifiée, les époux sont convoqués devant le juge aux affaires familiales pour la suite de la procédure de divorce.

Le jugement de divorce est la décision rendue par le juge aux affaires familiales qui met fin officiellement au mariage. Il intervient à la fin de la procédure de divorce, après l’examen des arguments et des preuves présentés par les deux parties, et après les audiences éventuelles. Le jugement de divorce détermine les conditions finales du divorce, y compris la garde des enfants, la pension alimentaire, la prestation compensatoire, et la répartition des biens. Il peut aussi contenir des mesures concernant le droit de visite et d’hébergement. Le jugement de divorce dissout officiellement le mariage et permet aux ex-époux de se remarier. Il fixe également les obligations de chaque partie conformément aux décisions du juge.

Comment est délivrée l’assignation en divorce ?

L’assignation en divorce est un acte de procédure formel qui introduit l’instance en divorce devant le Tribunal judiciaire.  L’assignation est préparée par l’avocat de l’époux demandeur, qui doit inclure toutes les mentions obligatoires et les pièces justificatives conformément au Code de procédure civile.

Une fois l’assignation rédigée, l’avocat la remet à un huissier de justice. L’huissier est chargé de signifier l’assignation à l’époux défendeur.  L’huissier de justice remet l’assignation en main propre à l’époux défendeur ou, à défaut, la dépose à son domicile.  Si l’époux défendeur est introuvable, l’huissier peut effectuer la signification par tout moyen conforme à la loi, comme le dépôt en mairie ou l’envoi par courrier recommandé.

Après la signification, l’huissier retourne l’assignation signifiée à l’avocat du demandeur, accompagnée d’un certificat de signification qui prouve que l’acte a bien été remis à l’époux défendeur. L’avocat du demandeur dépose ensuite l’assignation signifiée au greffe du Tribunal judiciaire compétent.  Ce dépôt marque le début officiel de la procédure de divorce.
